To Close Activision's Deal, Microsoft Agrees To Keep ‘Call Of Duty' On Playstation For 10 Years

In order to ensure that "Call of Duty" was available on devices other than simply Microsoft's MSFT, -0.18% Xbox platforms, the U.K.'s Competition and Markets Authority declared in February that it would prohibit the acquisition unless it was sold. The producer of the PlayStation, Sony 6758, -0.29% SONY, +0.92% concurred with the U.K. in its response to the CMA. Regulators recommended either blocking the acquisition or selling "Call of Duty" to another company.

But, Microsoft told the CMA that as part of a 10-year agreement to provide games to Nintendo Co. 7974, +1.34% and Nvidia Corp.'s NVDA, +3.83% cloud gaming service, it has already implemented measures to guarantee widespread availability.

If the transaction is approved, Microsoft claims that the contracts with Nintendo and Nvidia will make "Call of Duty" available to 150 million more gamers worldwide. Additionally, the business stated that it would be open to negotiating a comparable agreement with Sony for the Activision Blizzard ATVI, +0.28% game.

"In addition to the legally binding contracts decided to enter into with Nintendo and Nvidia, Microsoft is going to propose a package of licensing remedies which I ensure parity between both the PlayStation and Xbox platforms with respect to Call of Duty and (ii) ensure widespread availability of Call of Duty and other Activision games on cloud gaming services," Microsoft said in a filing with regulators.

Microsoft's stock fell 0.8% in trade on Wednesday, while Activision's stock increased by 0.3% and Sony's American depositary receipts increased.
